Calcutta High Court reinstates CRPF jawan dismissed on charges of second marriage

A CRPF jawan posted in West Midnapore district of West Bengal was fired from the job due to allegations of second marriage. However, the Calcutta High Court has said that he was fired from the job purely on the basis of hearsay and suspicion. The court further said that if the action continued, it would cause professional, personal and emotional difficulties to the jawan and ordered his reinstatement.

According to Justice Ajay Kumar Gupta, court It was not acting as an appellate authority when reviewing disciplinary action against jawans, but it could intervene when the outcome was controversial, without evidence or in violation of laid down principles of law.

Fired from job on charges of second marriage

This person hailing from Karnataka has been working as a constable in CRPF for 24 years. He was accused of eloping with a woman from Tripura and marrying her in 2001, even though he already had a wife.

Remarrying for the second time is against the rules and conduct rules of CRPF and the soldier was fired from the job on June 11, 2020. However, the constable claimed that he had only one wife and they got married in 1997. The court was told that this allegation arose due to mistaken identity and wrong entry.

The appeal was rejected earlier

On September 29, 2020, he appealed to the Deputy IGP of CRPF, Range Yalahanka in Bengaluru, but failed. On 5 March the following year, a revisional application was rejected and on 6 October the same year, another appeal before a different authority was again rejected.

Then he approached Calcutta High Court. Additionally, the man had also allegedly deposited a fake hostel subsidy and had already been punished for the same.

The High Court said that the constable was found guilty of second marriage in the departmental proceedings on the basis of hearsay and police report only and there was no concrete evidence that the marriage was valid. As a result, the court has reinstated the constable in Midnapore.
