Court recorded Kejriwal’s argument… decision on change of judge will come at 4:30 pm

Today Delhi Court will give its verdict on the petition to change the judge in the excise case. The court will give its verdict on the application of Arvind Kejriwal and others, in which a demand has been made to remove Justice Swarnkanta Sharma from hearing in the excise policy case. Delhi High Court will give its verdict at 2:30 pm. Arvind Kejriwal again appeared in Delhi High Court today through video conferencing. Arvind Kejriwal's new affidavit was not taken on record. Kejriwal will again present his case in the court to bring the rejoinder on record.

Arvind Kejriwal appeared before the court for the fourth time on Monday in connection with the application by Aam Aadmi Party supremo Arvind Kejriwal to change the judge in the excise case. Arvind Kejriwal joined Justice Swarn Kanta Sharma through video conferencing and said that we have filed a rejoinder. Please take it on record.

'No plea will be recorded'

Opposing Arvind Kejriwal's argument, Solicitor General Tushar Mehta said that on 13th he himself decided to come and debate, which no one opposed. They argued for an hour. When they were told that the matter would end today, they left. The decision is reserved. Let me make this clear. In any court across the country, as soon as the case is reserved, no arguments are made on record. It is followed throughout the country. Nevertheless he said that he wanted to file another affidavit. I knew what was going to happen. After that I wrote and filed the submissions. There is no way to file a reply to the submission by writing anywhere in the country. Please do what any court would do to any litigant in this country.

'There is no rejoinder for written submission'

Arvind Kejriwal said that the registry is not accepting. CBI has filed its reply. Earlier it was showing accept and later it started showing reject. Tushar Mehta said that this is not an answer. This is a written submission.

Justice Sharma said that you should not say this at all. With you out of the way, your additional affidavit has been taken on record. Because you yourself were arguing. A rule of registry which is being filed for everyone. This is not an extraordinary case. This is a simple case like everyone else's. After reserving the order, I took additional affidavit on record. He (SG) is right that there is no rejoinder for the written submission. You could have filed a returned submission. You did not do what was given in the time. We will never change the court procedure for a particular person.

Justice Sharma said that but still, because the verdict is to be pronounced today at 2:30 pm. I will take your reply on record in the form of a written statement. I am giving this relaxation to Kejriwal. Solicitor General Tushar Mehta said that no other common man would have got this extra benefit. Justice Swarn Kanta Sharma said that I will now pronounce the order at 4:30.
