New Delhi: On Thursday, the Supreme Court declined to consider a public interest litigation (PIL) that called for a judicial investigation into the Pahalgam terror incident from April 22, which resulted in the deaths of 26 individuals.

A panel comprising Justices Surya Kant and N Kotiswar Singh criticized the petitioners for their request to appoint a retired judge to oversee the investigation, stating that retired judges lack the necessary expertise in such matters.

The bench remarked, "At this critical juncture, every citizen is united in the fight against terrorism. Is your intention to demoralize our security forces by filing such a PIL? This matter should not be brought before the judiciary."

The petitioners, led by Fathesh Kumar Saahu, were urged to withdraw their PIL.

The court emphasized the importance of recognizing the sensitivity surrounding the issue and cautioned against making requests that could undermine the morale of the forces.

"You are suggesting that a retired Supreme Court judge conduct the investigation. They are not trained investigators; their role is to adjudicate. Do not expect us to issue an order. You should withdraw your petition," the bench advised one of the petitioners.

The PIL aimed to compel the central government and the Jammu and Kashmir administration to enhance tourist safety measures.

On April 22, terrorists opened fire in Baisaran, a well-known tourist destination in Pahalgam, Anantnag district, leading to the tragic loss of 26 lives, predominantly tourists from other states. This incident has heightened tensions between India and Pakistan, with Prime Minister Narendra Modi vowing to pursue the perpetrators "to the ends of the earth."
