Washington : The Donald Trump administration has once again suffered a major setback from the American courts. An American court has suspended Liberation Day Tariff launched by President Donald Trump. According to the information received, the Manhattan federal court has given this decision. The court said that President Trump is misusing his powers. The court also said that they have taken steps against the US Constitution.
In March, Trump also ordered a similar tax imposition of taxes on those countries that impose high taxes on American goods. He declared this decision by Mukti Divas. On 2 April 2025, Trump announced a mutual tariff on several countries. But his decision created a stir worldwide. Many American businessmen had gone to court.
After this, while hearing this petition, a bench of three judges of the International Trade Court banned the decision of Donald Trump. The court said that under the US Constitution, only the US Congress has the right to determine the foreign trade policy, not to the President. The court has also clarified that the matter does not fall under the President’s emergency powers.
Trump has also imposed tariffs under the International Emergency Economic Power Act (IEEPA). But this law does not give unlimited powers to the President. The order issued by the court states that the decision to impose unlimited fees by the President is beyond the right to law. Trump has imposed an illegal tariff.

The Trump administration, explaining its decision, cited Richard Nixon’s 1917 decision. At that time, the then President imposed this tax under the Emergency. The administration said that the court does not have the right to determine the validity of emergency. This is the right of the Congress. But the court has rejected this argument of Trump Prashan.
A group of small American businesses and the Attorney General of 12 Democratic states have filed a case against Trump’s decision. Both these groups have filed a petition arguing that the imposing global tax of Trump is out of their jurisdiction under the IEEEPA Act.
The Liberation Federal Day tariff decision of the Trump administration can be challenged in the US Appeal Court for the federal circuit. After this, the matter will go to the Supreme Court. This is not the first time an American federal court has declared Trump’s tax growth illegal. At present, everyone’s attention is focused on what Donald Trump will decide on this.
