Bail received with conditions
The Karnataka High Court has granted interim bail to Nikhil Sosale, marketing head of Royal Challengers Sports Private Limited. The court has ordered that they have to submit their passport to get bail. The last hearing of the case was postponed by the court till Wednesday. Now Justice S.R. The court, led by Krishna Kumar, accepted the bail petitions of three other accused, including Nikhil Sosale.
Questions raised on arrest
In this case, the petitioners argued in the court that he was arrested on the orders of Chief Minister Siddaramaiah without any prior investigation. He also said that the police officers who detained him had no legal right to investigate or arrest this stampede case. On the other hand, the state government dismissed these allegations and said that all the arrests have been made following the entire legal process. The police have taken action under the rules.
Can the Chief Minister order arrest?
On behalf of the government, Attorney General Shashikaran Shetty objected to the petition, saying that the petitioners had not mentioned all these allegations earlier. In response, the petitioner’s counsel Sandesh Chauta said that the Chief Minister had clearly directed the officials to arrest the accused in a press conference, even though it does not come under their jurisdiction. On this, the bench questioned whether the Chief Minister does not have the right to give such an order? Advocate Chauta said in response that according to several old comments of the Supreme Court, the Chief Minister cannot directly order such arrests.
RCB got relief from High Court order
It was argued by the RCB side that hasty action has been taken in the stampede case. Giving an example, the senior lawyer said that a judicial inquiry was conducted in the stampede that took place in Andhra Pradesh due to falling wall of a temple. Action was taken on the advice of experts. In this case, a PIL was filed on the very next day of the incident and then an FIR was registered.
On behalf of the government, AG Shashikaran Shetty said that the accused were arrested while trying to leave the country. He requested the court not to grant interim bail. At the same time, RCB senior advocate CV Nagesh argued that the intention of any accused in this incident was not to deliberately harm. The Chief Minister and the Deputy Chief Minister himself invited the fans to the program.
