Parents take care of the smallest needs of their children. In such a situation, it is the duty of children to serve parents in old age, which is also a part of Indian culture somewhere. But these days cases of misconduct with the elderly are also increasing. Even after looting love on children, they do not get respect and comfortable life after retirement. The Government of India has enacted strict laws to protect the interests of senior citizens. But very few people know about them.

Often parents face many difficulties due to not being financially strong in old age. Children also are not ready to give maintenance. Because of this they feel helpless. Explain that with the help of Indian law, elderly parents can also demand alimony. The elderly get legal protection under the Domestic Violence Act 2005 and the Senior Citizen Act 2007 in India.

From whom should parents demand maintenance? (Maintenance Act)

The Maintenance and Welfare of Parents and Senior Citizen Act 2007 includes financial security, expenses for maintenance, medical security. There is also exemption in pension, schemes, banking and other government work. In old age, the child or successor is responsible for the care of parents. If not doing so, they can also take help of the law. Parents can demand alimony from both son or daughter. If they have no children, then in this situation the successor who is entitled to the property will have to fulfill this responsibility.

Provision for 3 years jail and fine

Domestic violence, misconduct, economic exploitation, mental and emotional violence can file a petition in the court. After which the court can also issue an order to leave the child home. If the crime is established, it can also be imprisoned for 3 years. Court can also cancel the transfer of property

  • If children are careless carelessness, they can also be fined or jail of Rs 5000. Can complain to the tribunal for help.
  • If someone forcibly comes out of the house, then legal action can also be taken against it.
  • Maintenance can be demanded in court. Legal assistance for free is also provided by the government if there is less than Rs 4 lakh.
