Supreme Court's Decision on Paramedical Admissions

The Supreme Court has paved the way for the resumption of the admission process for paramedical courses in Madhya Pradesh for the academic years 2023-24 and 2024-25.


This decision follows a ruling from the Jabalpur bench of the Madhya Pradesh High Court, which had imposed a stay on the recognition and admission process for these courses on July 16, based on a petition filed by a law student association.


Senior advocate Mukul Rohatgi, representing the registrar of the Madhya Pradesh Paramedical Council, informed the bench led by Chief Justice B.R. Gavai and Justice K. Vinod Chandran that the High Court's strict order stemmed from a petition by law students who had no direct connection to the matter.


Rohatgi highlighted the impact of the COVID-19 pandemic, noting that the outbreak had delayed the timely commencement of certain paramedical courses across states.


He emphasized that the registrar of the paramedical council is responsible for granting recognition to institutions and overseeing the admission process, and the High Court's order had effectively halted all activities.


In response, the Chief Justice questioned how law students could file such a petition, leading the Supreme Court to stay the High Court's order. The Chief Justice also issued notices to the state government and others regarding the paramedical council's petition.


The High Court's suspension order had previously allowed 166 paramedical institutions to initiate courses for the 2023-24 academic year, despite their recognition not being granted until 2025.


The High Court deemed the timeline 'illogical' and raised concerns about how institutions could commence the 2023-24 academic session in 2025 when they did not even exist at that time.
