The Calcutta High Court has asked a husband to pay up to 60 percent of his pension as maintenance to his divorced wife. The High Court has asked to pay alimony of about Rs 25,000, which is 60% of the pension as per the ITR. It will also increase by 5 percent every 2 years.

The husband said that the alimony was fixed at this amount when his salary used to be Rs 1 lakh 30 thousand per month. When he used to work at UCO Bank. But, due to work pressure, he has resigned from the job. Now his pension is only Rs 42 thousand, out of which the court has asked to give Rs 25,000 every month to his wife.

The court had earlier reduced the allowance.
When the matter reached the magistrate court in 2023, the magistrate court said that the wife admitted in her cross-examination that her husband has now retired and she is living in her husband's house. She admitted that she had received money from Lakshmi Bhandar and also has a Sastha Sathi card in her name. The magistrate court cited several legal precedents and further cross-examined the evidence presented by the wife and finally reduced the maintenance amount awarded in the original matrimonial case. On December 30, 2023, the magistrate court said that the Rs 30,000 per month to be paid to the husband should be reduced to Rs 20,000.

Amount increased on wife's complaint.

However, in 2024, the wife appealed to the Kolkata High Court as she felt that the husband had reduced the maintenance amount. The wife's lawyers said that the husband earns from several sources, such as the stock market, provident fund, gratuity, and leave money, but he showed a lesser amount. Also, the High Court judge did not take into account the husband's retirement benefits, which he received as a senior bank officer. The husband's lawyers argued that he gets only Rs 42,000 pension every month and he cannot pay the maintenance amount demanded by the wife. But after hearing these arguments, finally the Calcutta High Court said that the husband will have to pay alimony of Rs 25,000 per month to the wife to lead a dignified life.
