Apart from the Supreme Court, a similar comment has also been made by the Bombay High Court. Now the question is that if the voter card, PAN card or Aadhaar card does not prove citizenship, then what is necessary for this?

Bombay High Court's big comment

The Bombay High Court heard the petition of a man who illegally from Bangladesh. During this hearing, making a big comment on behalf of the High Court, it was said, Aadhaar card, PAN card or voter ID card are only identity cards or documents taking advantage of services, by making these documents, no one becomes a citizen of India. The High Court made this comment and refused to grant bail to the Bangladeshi citizen.

The Supreme Court has made it clear many times before that Aadhaar card is not a document to prove citizenship. Now, during the hearing on the petitions filed about the voter list revision in Bihar, the Supreme Court said that the argument of the Election Commission is absolutely correct that Aadhaar is not a decisive proof. Even in the Aadhaar Act, it is not considered a proof of citizenship.

What is citizenship?

First of all, it is important to know what is cervical. Citizenship is a special right, which is given to its citizens on behalf of any country. In this, citizens have legal rights, right to job and right to contest elections.

Under the Citizenship Act 1955 in India, people are given the right to citizenship by the government. Under this law, one's citizenship can also be abolished. According to this law, a citizen of India cannot be a citizen of any other country. That is, India does not accept dual citizenship.

How to get citizenship?

According to the Citizenship Act 1955, if you are born in India, then you can take citizenship of India. It states that after 1 July 1987, the person born in India will be called a citizen of India, at the time of his birth, one of his mother or father should be a citizen of India. That is, a birth certificate can also be a document to prove citizenship.

If a child is not born in India and at the time of his birth, the mother or father is a citizen of India, then the child can get citizenship. It is necessary to register a child born abroad within a year in the Indian Embassy.
  • People from other countries can also apply for citizenship from the Government of India. Different conditions have been fixed for this.
  • Citizenship is also given through land expansion. If India takes any region in its possession or involves it in the country, then the people living there get citizenship of India themselves.
  • Citizenship can also be obtained through Naturalization. In this, people living in the country for many years can apply for citizenship. For this, the rules of the third schedule of the Citizenship Act have to be followed.

Citizenship documents

  • You cannot prove your citizenship even with all documents like Aadhaar card, PAN card, voter ID and ration card.
  • A birth certificate or domicile (residence certificate) can be given to prove citizenship.
  • Birth certificate issues Gram Panchayat, Municipality or Municipal Corporation.
  • If you do not have a birth certificate, then you will have to get a non -availability certificate from the local birth and death registration office. After this you can get a birth certificate.
  • To get a domicile or residence certificate issued by the state government, you will have to stay in that state for three years. You can make it through a copy of the family register, birth certificate or school certificate.
