The trend of buying and selling second-hand two-wheelers and four-wheelers is rapidly increasing in India. If you're selling a vehicle, you should check all the necessary documents to avoid any legal complications later. The most crucial aspect of buying or selling a vehicle is the RC transfer, which fully transfers the vehicle's ownership. Additionally, documents such as insurance, PUC, fitness, and finance should be checked. Clearing all these documents protects you from all legal liabilities.

Consumer Affairs Advocate Pawan Nanhoria explains that just as when we buy a new vehicle, Sections 42, 43, 44, and 45 of the Central Motor Vehicles Act state that without registration, the vehicle cannot be driven on the road, meaning it cannot leave the showroom. Similarly, when buying or selling a used vehicle, it should be ensured that the seller immediately transfers the vehicle to the buyer's name.

Whenever a vehicle is involved in an accident, a case is registered. It is always in the name of the person in whose name the vehicle is registered. That is, the one who owns the vehicle. Therefore, when buying a vehicle, along with checking the registration, one should also check the insurance and fitness tax. The important thing to check in the registration is whether the vehicle is financed, and you have bought it. In this, it happens that the person sold the vehicle and you bought the vehicle, but have not obtained NOC from the finance company, then the finance company will seize the vehicle or will repossess it by filing a case in the court. Therefore, while renting or selling the vehicle, both the buyer and the seller should get the transfer done with utmost caution.
