A hearing was held in the High Court on Monday in the case of assault on a lawyer in Delhi's Tis Hazari Court. The hearing was conducted by a bench of three senior most judges of Delhi High Court. The court, taking a strict stance on the incident, has directed the concerned DCP to provide security to the victim's lawyer and conduct an impartial investigation and submit a report. The court has also sought response from the District Court.
A bench of Chief Justice Devendra Kumar Upadhyay and Justices V Kameshwar Rao and Nitin Sambre said that the court will hear the case on February 24. During the hearing, Additional Solicitor General Chetan Sharma said that Delhi Police knows the facts. DCP North is connected through video conferencing. It seems there is some background to this. There is something behind this. The security of the lawyer or the propriety of the court proceedings cannot be breached.
Standing Council (Criminal) action of Delhi Government is being taken in this matter, FIR will be registered.
The court said that a lawyer was beaten and misbehaved with him. According to reports, the gate of the court room was closed. What about the behavior of lawyers? ASG said that if there is a scuffle between lawyers in the court, then it is a violation of conduct rules. DCP of Delhi Police told the court that we have received complaints from both sides. MLC action is being taken, we will file an FIR. If there is a need to do something else on the basis of CCTV footage etc., we will do it.
The court asked the DCP what do you think about improving the security in the court? DCP said that we will meet the District Judge and see how security can be improved. The court asked what about the security of the lawyer who had raised this matter before us? The DCP told the court that he had not asked for any security.
The court said that we are directing you to give 24 hours security to the victim's lawyer, at least until we get the report from you and the District Judge.
The court directed the DCP to investigate the case without any pressure from any side. In a completely independent manner so that we can find out the truth and act accordingly. The investigation will be conducted by the ACP under the direct supervision of the concerned DCP.
