Impeachment Motion Against the CEC : Amid assembly elections in five states, the impeachment motion brought by the opposition to remove Chief Election Commissioner Gyanesh Kumar from the post has been rejected in the Houses of Parliament. Rajya Sabha Chairman CP Radhakrishnan and Lok Sabha Speaker Om Birla on Monday rejected the opposition’s notice to bring a motion to remove the Chief Election Commissioner from his post. After which the politics of the country has started heating up.
On the impeachment motion against the CEC being rejected by the Rajya Sabha Chairman and the Lok Sabha Speaker, Congress leader Nana Patole said, “There was no valid reason for rejecting the notice. The government has to support the Election Commission, and on that basis, both the Rajya Sabha Chairman and the Lok Sabha Speaker rejected the motion. This clearly means that the Narendra Modi government is stifling democracy through the Election Commission and is trying to hide its wrongdoings.”
Shiv Sena (UBT) leader Sanjay Raut said, “The present Election Commission has been entrusted with one task, and that is to work in favor of the BJP. Gyanesh Kumar has been entrusted with this task because the BJP cannot win in Bengal through democratic means. Therefore, if we have talked about bringing an impeachment motion against him, the government will definitely try to protect him, as it has always been protecting people who undermine democracy and public sentiment. Now we will see what happens in Bengal, how successful the people who are working in favor of BJP or the government are, but I have full confidence that the people of Bengal will not let their plans succeed.
Election Commissioner accused of bias
The opposition had submitted an impeachment notice against Chief Election Commissioner Gyanesh Kumar to Rajya Sabha Chairman CP Radhakrishnan and Lok Sabha Speaker Om Birla, leveling serious allegations against him including biased and discriminatory attitude, willful obstruction of the investigation into electoral fraud and large-scale disenfranchisement. However, the Rajya Sabha Chairman and the Lok Sabha Speaker, in separate orders, refused to accept the notice seeking Gyanesh Kumar’s removal under Article 324(5) of the Constitution.
A notification issued by the Secretary General of the Lok Sabha in this matter said – “Decision of the Speaker of the Lok Sabha on the notice of motion under Article 324(5) of the Constitution of India, read with other relevant constitutional and statutory provisions; this notice requests the removal of the Chief Election Commissioner Shri Gyanesh Kumar from the post of Chief Election Commissioner.”
Members are informed that notice of a motion dated the 12th March, 2026, signed by 130 Members of the Lok Sabha, under Article 324(5) of the Constitution of India— read with Article 124(4) of the same, Section 11(2) of the ‘Chief Election Commissioner and other Election Commissioners (Appointment, Conditions of Service and Tenure of Office) Act, 2023’ and the ‘Judges (Inquiry) Act, 1968′ read with—was presented to the Honorable Speaker of the Lok Sabha; In this notice, a demand was made to remove Chief Election Commissioner Mr. Gyanesh Kumar from the post.
It further states – “After due consideration of the notice of motion and careful and impartial assessment of all relevant aspects and issues contained therein, the Hon’ble Speaker of the Lok Sabha—in exercise of the powers conferred on him under Section 3 of the ‘Judges (Inquiry) Act, 1968’—has declined to accept the notice of the said motion.”
