Arvind Kejriwal on Monday cross-examined the petition seeking recuse of Justice Swarnakanta Sharma from the hearing in the Delhi High Court on the CBI's petition against the trial's acquittal in the excise case. During the hearing on the recusal petition, Kejriwal first told Justice Swarn Kanta Sharma that I personally respect you and the judiciary a lot but I have some doubts in my mind. I have 10 reasons for rejection. In response to this, Justice Swarn Kanta Sharma said that I also respect you a lot.
Kejriwal enumerated 10 reasons for withdrawing from the hearing
Without hearing the accused, the order of the Sessions Court was declared wrong.
ED did not file any case but Delhi High Court put a stay on the ED case in the Sessions Court.
The investigating officer of CBI had not even filed the case in the court and then the proceedings against him were stayed.
The accused were given only one week's time to file their reply whereas in other cases, 5-6 months' time was given.
Justice Swarankanta Sharma had already declared the accused guilty while ordering the bail application of the accused.
Union Home Minister Amit Shah had already told everyone about the order of the High Court that Kejriwal will have to go to the Supreme Court against the order of the Delhi High Court.
We are strongly against the ideology of RSS. You participated in the programs of his All India Advocates Council 4 times. This gives rise to doubt.
All the orders passed by Justice Swarnakanta Sharma so far show that she accepts all the arguments and demands of CBI and ED in letter and spirit. She even orders more than what they ask for. Even if Tushar Mehta says something orally in the court, its order is passed immediately. In such a situation, how will we get justice from them?
Referring to social media, Arvind Kejriwal said that there is an old tradition that if the close or relatives of a judge have relations with the other party, then they should recuse themselves from the hearing.
Arvind Kejriwal argued that before this about 5 cases related to us came before this court, in all of which adverse comments were made by the court. Later, the Supreme Court canceled the same cases and even granted bail. The hearing in our case was also hurried.
