New Delhi: While giving a very important and historic decision on Monday, the Supreme Court has made it clear that physical relationship between two unmarried adults with mutual consent cannot be used as the basis for bad character of any person. The top court of the country said in very strong words that there is no such law in our country, which prevents two adult and unmarried people from having a relationship as per their wish and choice.
The bench of Justice Manmohan and Justice Manoj Mishra made this historic comment during the hearing of a case to Telangana State Level Police Recruitment Board. With this decision, the Supreme Court accepted the appeal of the candidate whose recruitment for the post of Police Constable was canceled by the Board only on this basis. The court has immediately directed the Recruitment Board to reinstate that candidate on the job and give him an appointment letter.
According to the PTI report, the appointment of this candidate for a government job was rejected by the Police Recruitment Board only because in 2014, a case of rape on the pretext of marriage was registered against him. The Recruitment Board considered this to be a serious case of moral turpitude and declared the candidate completely ineligible for police service. The candidate did not accept defeat against this decision of the Board and approached the Supreme Court.
When the documents of this case came before the court, it became clear that this entire controversy was actually to a failed love affair. According to government records, both the candidate who got the job and the woman who complained were neighbors and were in a close relationship with each other for about four years. Later, a mutual settlement was reached between the two parties and in the year 2015 itself, this matter was ended forever through Lok Adalat. In this case, no charges were proceeded under section 376 of the IPC. The Court reminded that no one can be considered guilty until the allegations are proved in the court.
In another similar important case, the Supreme Court has also made its strict attitude clear regarding jobs and education. In another decision on Thursday, the Supreme Court said that some posts are reserved only for people with less education or less educational qualification. If a person deliberately hides his higher degree or higher qualification to get such jobs, then it is completely wrong in law.
The court clearly said that doing so would be tantamount to snatching employment from a poor or less educated person who was the rightful owner of that post. Therefore, even if a candidate gets a job by hiding his high qualification, if caught, his job will be considered invalid i.e. illegal.
