In Bengal, CM Shubhendu opened the shackles of CBI, Mamata’s decision reversed; Now permission is not necessary for investigation

In West Bengal, central agencies required government permission for any investigation. This time the BJP government of Subhendu Adhikari has changed the decision taken during the time of Trinamool. The Central Investigation Agency has been given general permission for investigation. Subhendu Adhikari's government has given full permission or 'consensus' for CBI investigation in West Bengal.

The government has said that under Section 6 of the Delhi Special Police Establishment Act, 'general consent' has been given for investigation in the entire West Bengal.

Due to the new decision, CBI (DSPE) has again got the consensus to conduct investigation in the entire West Bengal under the Delhi Special Police Establishment Act, 1946. From now on, if any complaint is made against any employee of the Central Government, Central Agency or any public or private person, CBI Will be able to investigate directly.

Now CBI will be able to investigate without permission

CBI will not need any permission to investigate allegations against Central Government employees working in the state. However, in case of state government employees, CBI will require prior written permission.

In 2018, the then Trinamool government had withdrawn complete permission for the CBI investigation in the state. Because of this, the CBI now had to obtain separate permission from the state for each case.

The Mamata Banerjee government had decided to withdraw that entire permission using Section 6 of the Delhi Special Police Establishment Act. This time, CBI was allowed to investigate using the same clause.

The pace of investigation will increase in Bengal

Even after withdrawal of 'General Consent' in 2018, CBI was registering FIR in one case after another. The Trinamool government of that time had gone to the Supreme Court opposing this. In that case, the central government had claimed in an affidavit that the state does not have such unlimited powers.

The state cannot use this power to hide any accused or for political gains. Not only West Bengal, but almost all the anti-BJP state governments of the country have withdrawn the 'General Consent' for the CBI investigation.

While this decision of the administration is expected to increase the pace of CBI investigation in the state, a new legal and political conflict has also started by maintaining the condition in the case of state government employees.
