Tezzbuzz Desk – A new petition has been filed in the Supreme Court regarding the use of lathi charge and tear gas during the student demonstration at Jantar Mantar. The petition demands registration of FIR against the concerned policemen and preservation of all digital evidence.
The case of alleged lathi charge during the student protest at Jantar Mantar in Delhi has now reached the Supreme Court. Advocate Narendra Mishra has filed a petition in the apex court demanding registration of FIR against the policemen who are accused of using force against the protesting students.
The petition states that to ensure a fair investigation into the case, all electronic and digital evidence to the incident should be preserved. This includes CCTV footage, body-worn camera recordings, drone footage, mobile videos, social media posts, police wireless communications, call logs, control room records and documents to duty deployment.
Earlier, advocate Narendra Mishra had verbally raised the demand for action against Delhi Police before Chief Justice (CJI) Surya Kant in the same case. During that time the Chief Justice had said that it is not appropriate to seek intervention from the court only on the basis of a letter and the court’s time should not be wasted without a formal petition.
During the hearing, when the advocate mentioned the demands of the students and the alleged police action, the CJI made it clear that the court will consider the cases only as per the prescribed procedure. Later he also clarified that his comment was meant to take up the court’s time without a proper petition and not to comment on any particular person.
In recent days, students from across the country and workers of the Cockroach Janata Party (CJP) were protesting in many areas of Central Delhi including Jantar Mantar. The main demands of the protesters were to fix accountability in the alleged paper leak cases in the examination and resignation of the then Union Education Minister Dharmendra Pradhan.
During the protest, when some groups tried to march towards Parliament, Delhi Police stopped them. During this time, incidents of confrontation between police and protesters came to light, in which there were allegations of lathi charge and use of tear gas.
The students’ protest ended after the resignation of Union Education Minister Dharmendra Pradhan on July 25. However, the legal battle regarding the police action at Jantar Mantar has now reached the Supreme Court. If the court accepts the hearing on this petition, then further important legal process can begin regarding the police action and investigation of available evidence in the case.
