No traffic constable can take out the keys of your vehicle or the air in the tyre, know these rules immediately

In such a situation, if the traffic constable is taking out the keys from your vehicle, then this is also against the rules. The constable does not have the right to arrest you or seize the vehicle. Also, no traffic policeman can harass you without reason. In such a situation, you can also take action against him. However, many people do not know this. They get scared seeing the traffic police making a mistake. Actually, under the Indian Motor Vehicles Act 1932, only an ASI level officer can issue a challan for traffic violation. ASI, SI, Inspector have the right to impose spot fine. Traffic constables are only there to help them. They do not have the right to take out the keys of anyone's vehicle. Not only this, they cannot even take out the air from your vehicle's tire. They cannot even talk to you in a wrong way or misbehave with you.

You should also keep these things in mind
1. To issue you a challan, the traffic police must have a challan book or an e-challan machine. If they do not have either of these, then your challan cannot be issued.

2. It is also necessary for the traffic police to be in uniform. The buckle number and name must be written on the uniform. In case of not wearing uniform, the policeman may be asked to show his identity card.

3. The head constable of the traffic police can only fine you Rs 100. Only the traffic officer i.e. ASI or SI can impose a higher fine than this. That is, they can issue a challan of more than Rs 100.

4. If a traffic constable takes away the keys of your vehicle, then make a video of that incident. You can go to the police station of that area and show this video to a senior officer and complain about it.

5. While driving, you must have the original copy of the driving license and pollution control certificate. Photocopies of vehicle registration and insurance may also be useful.

6. If you do not have money on the spot, you can pay the fine later. In such a situation, the court issues a challan, which has to be paid in the court. During this time, the traffic officer can keep your driving license with him.

Action will be taken under sections 183, 184, 185
Giving information in this case, Advocate Gulshan Bagoria said that in the Motor Vehicles Act 1988, police personnel are not given the right to take out the keys of the vehicle during vehicle checking. During checking, if the police personnel ask for the driving license, the vehicle owner should immediately show the documents to the vehicle. Under Section 3, 4 of the Motor Vehicles Act 1988, it is necessary for all drivers to get their driving license. Under Section 183, 184, 185, the speed limit of the vehicle should be correct. Under the sections of drunk driving, careless driving etc., there is a provision of imprisonment from 6 months to 2 years, fine from one thousand rupees to two thousand rupees or both under these Acts.
