Rashid Alvi of the Congress said, “Constitution allows minorities to build their institutions” if the Supreme Court upholds the UP Madrasa Act

Rashid Alvi, a Congress leader, praised the Supreme Court’s ruling on Tuesday that the “Uttar Pradesh Board of Madrasa Education Act 2004” is constitutional, stating that minorities are permitted to construct their own Madarsas and university-style establishments and manage them as they see fit.

The Supreme Court affirmed the constitutionality of the “Uttar Pradesh Board of Madrasa Education Act 2004” earlier today, overturning the March 22 ruling of the Allahabad High Court that had declared the Act unconstitutional.

“I applaud the Supreme Court’s decision. The constitution makes it quite explicit that minorities are free to establish their own Madarsas and university-style establishments and manage them as they see fit. Nevertheless, it is regrettable if a court or the government renders a decision that violates the constitution, Rashid Alvi told ANI.

However, Justices JB Pardiwala and Manoj Misra, together with Chief Justice of India DY Chandrachud, ruled that the Madarsa Act was unconstitutional because it regulated higher education in regard to “Fazil” and “Kamil,” which is against the UGC Act.

Congress MP Pramod Tiwari responded to the ruling by saying, “The Allahabad High Court has dismissed the UP government’s argument that the Madrasa Act violates the Constitution. There is a lesson for PM Modi and the BJP in their discourse of ‘division and cut’ based on religion. Only when a nation is unified can it remain powerful.

When rendering a decision on appeals against the High Court’s ruling, the bench said that the Madarsa Act governs the educational standards in the State of Uttar Pradesh.

It also said that the state has the authority to control the quality of education provided by minorities and that their ability to run educational institutions is not unqualified.

The UP Madrasa Act was overturned by the Allahabad High Court on the grounds that it violated secularism, which is a fundamental aspect of the Constitution.

The BJP, however, emphasized its attempts to modernize madrasas by stating that the government operates in accordance with court rulings.

“The government operates in accordance with the ruling, regardless of whether it comes from the Supreme Court, High Courts, or any other court. One thing I would like to mention is that Yogi Adityanath is the one who has modernized Madarsas. On the one side, it’s the Quran, but on the other, it should be the computer, as PM Modi has said explicitly,” BJP Leader Mohsin Raza stated.
