Section 144 has been imposed throughout Delhi due to the crowd of farmers and the possibility of uproar. You must have heard the name of this section during every performance, dharna, movement and such events. It is used by the police and administration to bring the situation under control and to give the public a general warning that action can be taken against them if they join the nuisance.
Usually when Section 144 is applied, the first task is to ban meetings. It is applied by declaration during processions and demonstrations that the crowd is not allowed to gather. Several other sanctions are also applied so that the protesters can be prosecuted as soon as the violations are done and remain valid in the eyes of the law. Let us understand Section 144 in detail …
Section 144 CRPC is installed. It is used to maintain peace and avoid emergency. Where Section 144 is applicable, three or more people cannot gather together at a time. Section 144 is implemented in a particular area or in the entire district after the permission of high officials of the district like District Magistrate or Superintendent of Police.
The reason for the implementation of Section 144 has also been given the reason why this section is being imposed. It has also been told how long it will remain in force. Sometimes it is also given a discount of a few hours a day. The police may immediately detain or arrest the accused concerned for violating the restrictions imposed under Section 144.
Section 144 cannot be imposed for more than 2 months. However, under special circumstances the state government can extend it for a maximum of 6 months. It should be noted that not all restrictions that can be imposed under Section 144 should not be imposed simultaneously. The local administration itself decides which things have to be banned and not on whom.
