The Supreme Court has given an important decision to the live-in relationship. The court has clarified that if a woman has been in live-in for a long time, she cannot accuse her partner of having a physical relationship by pretending to marry. The court also said that in such cases it is difficult to prove that physical relations were made only because of marriage promises. It is noteworthy that the two spent time together for more than a decade. The court has considered it a case of rift in relations and freed the appellant male from criminal proceedings.

Relations for 16 years

The apex court has said that it is not possible to clarify in such cases that physical relations were only based on the promise of marriage. The woman alleged that she had a relationship with the accused bank officer for 16 years as a marriage promise. The petition was being heard by the bench of Justice Vikram Nath and Justice Sandeep Mehta.

The complainant is a lecturer. The court has rejected his petition. According to the report, the court says that both are educated and the relationship between them was established by consensus, as they used to visit each other's houses despite living in different cities. The court made it clear that this case is about a rift in the relationship.

Question to Supreme Court

The bench said that it was difficult to believe that the complainant kept accepting every demand of the appellant for about 16 years and agreed without any opposition that the appellant sexually abused him as a false promise of marriage. This long time of 16 years, in which the physical relationship between the two remained without any interruption, shows that there was never any element of rapist or fraud in the relationship. The court also mentioned that if it was assumed that marriage was promised, then being in a long -term relationship reduces the strength of their claims.
