Bengaluru Construction Laws, BESCOM, BBMP, Unauthorized Buildings, and Supreme Court Orders on Electricity Disconnection As a result, it has directed the Bangalore Electricity Supply Corporation (BESCOM) to cut off power to any structures under its control that are not authorized.
According to the BBMP, this action was carried out in accordance with the December 17, 2024, Supreme Court judgment.
The corporation has previously issued orders under Sections 356(1) and (2) and against prohibited structures under Sections 248(1), (2), and (3) of the BBMP Act. In order to effectively prevent unauthorized constructions, the circular states that going forward, the corporation must immediately disconnect the temporary or permanent electricity connection to any unauthorized building as soon as it issues an order under Section 248(3) of the BBMP Act, 2020 against such buildings.
Before providing electricity connections from the Bangalore Electricity Supply Corporation to buildings under its jurisdiction, BBMP has directed BESCOM to only connect buildings that have received a possession certificate from the Bruhat Bengaluru Mahanagara Palike.
BBMP measures to stop unapproved building
BESCOM shall make sure that the corporation has granted the “A” Khata and the plan permission for the construction of such structures if a temporary electrical connection is to be supplied during or prior to the building’s construction stage.
Any building’s temporary or permanent electrical connection must be cut off after an order issued under Section 248(3) of the BBMP Act, 2020.
It is important to confirm that the Bangalore Electricity Supply Corporation has given a completion or possession certificate for a structure before establishing a permanent electrical connection.
It has been directed that if the temporary connection to such a building is to be maintained after the Corporation’s plan approval’s validity time has passed, it must be verified that the Corporation has renewed the building plan permission.
