Prayagraj: The Allahabad High Court has recently approved bail for an individual accused of rape, stating that the complainant 'herself invited trouble' by visiting the accused's residence after consuming alcohol. This decision follows a Supreme Court intervention that halted a previous 'insensitive' ruling from another High Court judge regarding a rape attempt case.


The court noted that the complainant, an M.A. student, was deemed capable of understanding the implications of her actions. The ruling, delivered by Justice Sanjay Kumar Singh, highlighted that the woman voluntarily went out with friends, where they all consumed alcohol, leading to her intoxication.


The defense argued that the woman, along with her friends, remained at the bar until 3 AM and chose to go to the applicant's home for rest. They contended that her claims of being taken to a relative's flat and raped were unfounded and contradicted by the evidence.


The court remarked that both the victim and the accused are adults, and the victim's own statements suggested a possible consensual relationship rather than a case of rape. It was also noted that while a medical examination indicated physical trauma, the doctor did not conclude that sexual assault had occurred.


In granting bail, the court considered the overall circumstances, the nature of the alleged offense, and the arguments presented by both sides. The Supreme Court had previously stayed an Allahabad High Court ruling that trivialized certain actions as not constituting an attempt to rape, labeling it as a display of 'insensitivity' and 'inhumanity'.


These observations were made by Justice Ram Manohar Narayan Mishra in a ruling dated March 17.
