New Labour Code Comes Into Effect: Women to Receive Equal Pay as Men, Major Workplace Reforms Rolled Out Across India

The Central Government has implemented a major change in India’s labour laws aimed at improving the working conditions, financial security, and equality of workers across the country. Effective from 21 November, the new Labour Codes are now officially in force, promising timely wages, equal pay for women, safer work environments, and stronger social security benefits for all employees.

This major reform merges the earlier 29 scattered labour laws into four simplified and modern codes. By restructuring the labour system, the government aims to eliminate compliance complexities for businesses and ensure a fair, secure workplace for India’s 40 crore workers across various sectors.

The Four New Labour Codes

The government has combined essential provisions from outdated laws and created these four major codes:

  • Code on Wages, 2019

  • Industrial Relations Code, 2020

  • Code on Social Security, 2020

  • Occupational Safety, Health, and Working Conditions Code, 2020

Officials highlight that earlier labour laws dated back to 1930–1950, when industries and employment patterns were completely different. The new reforms are designed keeping modern work culture, technological changes and global standards in mind.

What Changes for Employees? Key Features of the New Labour Codes

These codes introduce several employee-friendly rules. Here are ten of the most significant guarantees workers will now receive:

Strict assurance of timely minimum wages
Every worker, regardless of the workplace size or industry, must be paid at least the notified minimum wage on time.

Mandatory appointment letters
Employers must provide written appointment letters to ensure transparency in job roles and terms of employment.

Equal pay for equal work
Women will now legally receive the same salary as men for the same job role and workload.

Wider social security coverage
Nearly 40 crore workers—including unorganized and gig-economy workers—will be covered under schemes like PF, ESIC, and insurance.

Gratuity rights for fixed-term employees
Workers employed on fixed contracts will be eligible for gratuity after just one year of service.

Free annual health check-ups
Employees above the age of 40 must receive one free health examination every year.

Double pay for overtime work
Any additional work beyond prescribed hours must be compensated at twice the regular wages.

Safety in hazardous workplaces
Industries involving hazardous processes must ensure 100% health protection.

Improved workplace justice systems
Industrial dispute resolution and social justice norms will follow international labour standards.

Empowerment for gig and platform workers
Delivery workers, ride-sharing drivers and freelancers gain access to welfare and security benefits.

Major Benefits for Women Workers

The government has strongly emphasized gender equality in the workforce. Under the new rules:

  • Women can work night shifts only with their consent and proper safety arrangements.

  • Every sector must provide equal job opportunities and protection to women.

  • Equal compensation for equal responsibilities is now enforceable by law.

These changes aim to increase women's participation in the workforce and improve their financial independence.

Transparency and Security Strengthened at Workplaces

Employers must ensure:

  • Timely salary payments

  • Safe and hygienic working conditions

  • Written and verified terms of employment

  • Better medical and insurance coverage

Large establishments with 500 or more employees must form a Safety Committee to standardize workplace protection measures.

A National OSH Board will be created to regulate and monitor safety, health, and working conditions uniformly across all sectors.
