Historic Ruling by Madhya Pradesh High Court Declares Bhojshala as a Temple

Following a landmark decision by the Indore bench of the Madhya Pradesh High Court, the Bhojshala-Kamal Maula complex has been recognized as a temple. On Sunday, devotees gathered at this historic site in Dhar to offer prayers before an image of Goddess Saraswati. Gopal Sharma, the coordinator of the Bhojshala Mukti Yagya, expressed to a news agency the urgency of retrieving the original statue of Goddess Saraswati from a museum in London. He emphasized that until the original statue is returned, the symbolic idol installed at the site will serve as a place of worship for devotees.


Court Directives and Implications

Sharma noted that the court has instructed the government to facilitate the return of the statue from London. The complex has now been officially designated as a temple, and plans are in place for the installation of the statue. However, until that occurs, the idol established recently will remain in place. Previously, the Indore bench of the High Court acknowledged that the disputed monument is religiously significant as it is a temple dedicated to Goddess Saraswati.


Cancellation of Previous Agreements

The High Court annulled a 2003 agreement made by the Archaeological Survey of India (ASI) that restricted Hindu worship within the Bhojshala complex and allowed prayers by the Muslim community. The court directed the central government and ASI to make decisions regarding the administration and management of the Bhojshala temple, while clarifying that the ASI retains overall authority for the control, supervision, preservation, and regulation of religious practices at the monument, which is protected under the ASI Act of 1958.


Future Considerations

In relation to the Hindu community's petition for the return of the statue from a museum in London, the High Court acknowledged that the central government has already received several representations on this matter. The court also instructed the state government to consider allocating land for a mosque in Dhar district if the opposing party applies for it. Shortly after the ruling, two petitions were filed in the Supreme Court, raising concerns that the Muslim side might challenge the decision.
