Kolkata: Multiple Flat Buyers Move NCLT Against Avani Group Alleging Fraud, Hearing On Monday

The National Company Law Tribunal (NCLT) will hear on Monday the case against Avani Group and its promoter, Aniruddha Daga for alleged fraud and delays in delivering promised flats to multiple homebuyers.

The case stems from petitions filed by several homebuyers claiming that despite investing significant sums in projects by the Avani Group, securing possession of their dream homes has turned into a nightmare for them.

The aggrieved homebuyers have claimed that over a decade has passed without the promised flats being delivered, as the projects remain halted and mired in legal complications.

Many buyers, who invested in Avani Group projects, claim that they were promised luxury accommodations which never materialised. Some buyers now find their cases entangled in the NCLT as they seek a resolution.

The buyers have alleged that not only many projects by Avani Group, including "Avani Grand" near EM Bypass in Kolkata, were never completed despite buyers making substantial payments. Customers, like Kritesh Chopra and Subir Das, were left waiting with no progress on construction.
  
One investor Kritesh Chopra has alleged that Avani Group and its promoter, Aniruddha Daga, not only collected payments but also borrowed from Reliance Capital, but did not use the funds for the projects. 

Several such homebuyers have moved NCLT, hoping that recent legal amendments will pave the path for completion of stalled projects through alternate developers.

It is also alleged that the issue is not merely limited to West Bengal, as many investors are from other states as well. One such investor is Dilip Kumar Somani, who hails from Assam and invested in Avani’s project for his son, only to learn that construction has not started.

The buyers are hoping for a relief from NCLT to help them recover their investments and possibly complete the projects through new developers. The case is listed for hearing on November 11 (Monday).
