Stand-up comedian Kunal Kamra on Monday moved the Bombay High Court seeking to quash the FIR filed against him over his "traitor" jibe at Maharashtra Deputy Chief Minister Eknath Shinde during his show 'Naya Bharat'. '
Kamra’s petition will be mentioned before senior counsel Navroj Servai and advocate Ashwin Thool before the bench of Justices Sarang Kotwal and SM Modak for an early hearing on Monday.
In his petition, Kamrahas claimed that the complaints lodged against him were violative of his fundamental rights of freedom of speech and expression, right to practice any profession and business and right to life and liberty guaranteed under the Constitution of India.
Earlier, in March, the comic approached the Madras High Court and got interim anticipatory bail in the case against him. Notably, Kamr,a who is currently in Tamil Na,du as shared by him on social media, is also a permanent resident of the state.
Meanwhile, Kunal Kamra has failed to appear before the Mumbai police for questioning despite three summons issued to him.
Kamra in his show, later posted by him on YouTube, jibed at Shinde using a modified version of a Hindi song from the film "Dil To Pagal Hai" where he called him a "gaddar" (traitor).
Following a complaint by Shiv Sena MLA Murji Patel, the police here registered the FIR against Kamra under Bharatiya Nyaya Sanhita sections 353(1)(b) (statements conducing to public mischief) and 356(2) (defamation).
