A rape suspect was granted bail by Allahabad High Court Justice Sanjay Kumar Singh, who argued that the “victim invited trouble and was equally responsible” for the incident.

According to the HC, there may be a mutually agreeable connection between the parties in this situation. The lady is an MA student; therefore, she “was competent enough to understand the morality and significance of her act,” according to Justice Sanjay Kumar Singh’s ruling from last month.

A number of individuals, including politicians, have questioned Justice Sanjay Kumar Singh’s ruling after the news was announced on Thursday. Priyanka Chaturvedi, a Shiv Sena (UBT) MP, said that the Allahabad high court is in dire need of competent judges. Although the SC delayed Justice Mishra’s prior, pitiful ruling, no action was done against him, and now we have this.

Justice Sanjay Kumar Singh: Who Is He?
– The Allahabad High Court website states that Justice Sanjay Kumar Singh was born in Mirzapur, Uttar Pradesh, on January 21, 1969.

– He graduated with a degree in science from the University of Allahabad’s Ewing Christian College in 1988.

In 1992, Dayanand College of Law, Kanpur, which is connected to Chhatrapati Shahuji Maharaj University, awarded him a law degree.

On May 9, 1993, Sanjay Kumar Singh registered as an advocate with the Uttar Pradesh Bar Council. He worked in Allahabad’s High Court of Judicature.

His father, the late Shitala Prasad Singh, a well-known criminal defence attorney and former government counsel in the Allahabad high court, guided him when he started his legal career.

– Sanjay Kumar Singh also handled matters in many writ jurisdictions, including civil, service, and education.

-On November 22, 2018, he was appointed an additional judge of the Allahabad High Court. On November 20, 2020, he was sworn in as the Allahabad High Court’s permanent judge.

The court rejected the accusations as untrue, finding that there was no reliable evidence to support the accused’s claim that he brought the girl to his friend’s apartment and raped her rather than at his own house.

“The victim’s claim that the applicant brought her to a relative’s apartment rather than his own and sexually assaulted her twice is untrue and contradicts the available evidence. According to the ruling, “it is argued that, given the facts of the case as revealed by the victim, it is not a case of rape but rather may be a case of agreements between the parties involved.”

According to the defence attorney, the accused is unlikely to have tampered with the evidence since he has been in custody since December 11. The attorney also gave the court his word that the accused would not abuse the freedom that was provided by bail.

“It is clear that the victim and the applicant are both majors after hearing the parties’ knowledgeable counsel and reviewing the case in its full. Being an M.A. student, the victim was capable of comprehending the morality and importance of her actions, as she revealed in the FIR.

This court believes that even if the victim’s claim is believed to be accurate, it may still be said that she caused the problem by inviting it and being accountable for it. In her statement, the victim has adopted a similar stance. Her hymen was discovered ripped during her medical examination, but the doctor did not provide an opinion on the sexual assault, the court said in the judgement.
