Under which sections can a case be filed for filing a false rape case?

If someone has done this as part of a conspiracy, then a case can be registered under section 316 (2) of the BNS as a case of criminal conspiracy. Apart from this, a case can be registered under section 73 for giving false information or making false allegations.

What can be the punishment?

According to the Indian Penal Code, if someone intentionally files a false rape case and it is proved. Then he can be given severe punishment. In such a case, giving false information under section 73 can lead to both 1 to 3 years of imprisonment and fine. On the other hand, under section 226, if the case is serious, then the punishment can be up to 7 years. And if this is done as part of a conspiracy, then under section 316 (2), a punishment of up to 2 years and a fine can also be imposed. In such cases, the court can also order the accused to pay compensation to the victim.
