Delhi High Court has issued a notice to the Election Commission of India (ECI) on a petition filed by a party named 'Sanatan Swaraj Party'. The petition seeks direction to the ECI to approve the name of the proposed political party and register it. This case was heard in the court of Justice Amit Bansal. The petitioner's lawyer said that my application is pending since last year.
The lawyer said that we have to contest the West Bengal Assembly elections in March. We have to get our names published in 8 newspapers which will take 45 days. After the hearing, the court said that this petition has been filed to direct the ECI to immediately approve the proposed name of the petitioner 'Sanatan Swaraj Party' and direct the ECI to register the proposed political party.
The petitioner says that this is necessary because the petitioner party wants to contest the upcoming assembly elections to be held in West Bengal. The court noted that the Election Commission has accepted the notice. The court said that a short affidavit should be filed within 2 weeks.
The Delhi High Court on Friday rejected a petition challenging the Election Commission of India's (EC) recognition of political parties as national or state-level parties.
The petitioner, Hind Samraj Party – a registered political party – had challenged the validity of the Election Symbols (Reservation and Allotment) Order, 1968, which classifies political parties as national parties or state parties. A bench of Justices Nitin Sambre and Anish Dayal said that the issues raised in the petition have already been resolved by the Supreme Court and the order should not be treated as having any legal force or being discriminatory. There is no reason for.
The petitioner argued that the Election Commission illegally recognized political parties at the national or state level, even though it had no power to do so.
