In a 12-year-old case, a Delhi court recently found criminal Salman Tyagi and his four men guilty of rioting and attempting to kill, while one of the defendants was found not guilty.

Tyagi and his men were prosecuted under the Maharashtra Control of Organised Crime Act (MCOCA) and other provisions after a formal complaint was filed in this matter at Police Station Hari Nagar in 2012.

Extra Sessions Salman Tyagi and his men Sahil alias Chota Roshan, S Mustafa Tyagi, Mansoor Tyagi, and Manish alias Deepak were found guilty by Judge (ASJ) Shivali Sharma of Tis Hazari Court of offenses pertaining to rioting with a dangerous weapon, attempted murder, and other connected offenses.

Salman Tyagi was also found guilty by the court of violating section 25 of the Arms Act.

Nevertheless, Mohd. Saddam alias Gauri was exonerated by the court of the charges against him. Deepak Sharma, an advocate, represented Saddam Gauri.

Salman Tyagi, Mansoor Tyagi, Mani Nasa (who is now deceased), Saddam Gauri, Deepu alias Bunda, and Sahil alias Chhota Roshan allegedly arrived at Shamshan Ghat road in front of VIP Ghori Baggi Wala, Tihar Gaon, Hari Nagar, in a car at around 12.30 am on the intervening night of September 24 and 25, 2012, according to the prosecution.

They allegedly carried iron rods, swords, and rifles among other weapons. The other accused, Mani Nasa, Saddam Gauri, Salman Tyagi, and Deepu, stepped out of the car and approached victim Salim, but accused Mansoor Tyagi and Sahil, also known as Chhota Roshan, continued to remain in the vehicle.

Salim was assaulted by accused Mani Nasa with an iron rod, by accused Saddam Gauri with a sword, and by accused Deepak with fist and leg strikes, according to the police. Salim yelled for assistance, and his mother Mujaffar, his nephew Javed, and a few of their staff members hurried to rescue him.

Accused Mansoor Tyagi and Chhota Roshan stepped out of the vehicle upon seeing them and threatened to shoot them if they attempted to assist Salim. Accused Mansoor Tyagi shot a gun at them when they refused to stop, but they escaped to save their lives.

Salman Tyagi shot Salim after stealing the handgun from Mansoor Tyagi during the chaos. Salim was spared the bullet wound, however, since the beatings he had previously received caused him to lose consciousness and collapse. The accused fled in their vehicle when they saw that a number of neighbors had begun to gather there after hearing the disturbance.

The current FIR was filed in response to Javed’s allegation. One pistol with two unlicensed live cartridges was found in the possession of accused Salman Tyagi on October 8, 2012; another loaded, unlicensed country-made pistol was found in the possession of accused Mani Nasa on October 4, 2012; and on October 20, 2012, an unlicensed sword was found in the possession of accused Mohd. Saddam alias Mohd. Gauri.

Eight defendants were charged by Delhi police under Sections 147/148/149/307/429/34 IPC and Section 25/27 of the Arms Act: Sahil alias Chhota Roshan, Mani Nasa, Salman Tyagi, Ibrahim Tyagi, Mustafa Tyagi, Mansoor, and Manish alias Deepak alias Deepu alias Bunda.

On October 25, 2019, and December 7, 2022, respectively, proceedings against accused Mani Nasa and accused Ibrahim Tyagi were halted during the trial.
