Explainer: Chahal-Dhanashree Divorce Settlement – How Courts Decide Alimony

Indian cricketer Yuzvendra Chahal and his wife, Dhanashree Verma, have officially parted ways. The Bandra Family Court has approved their divorce, and the Bombay High Court also waived the mandatory ‘cooling-off’ period to expedite the process.

As part of the divorce settlement, Dhanashree Verma has received ₹4.75 crore as alimony from Chahal. This amount was mutually agreed upon by both parties and approved by the court to ensure a smooth resolution.

How Is Alimony Determined?

In India, there is no fixed formula for calculating alimony. Courts assess each case individually based on several factors. The Supreme Court, in a landmark ruling last year, emphasized that alimony is not intended to punish one spouse but to provide financial security to the dependent partner. The court outlined eight key factors in determining alimony:

  1. Financial Status of Both Parties: The income and financial condition of both spouses are evaluated.
  2. Earning Potential: The court considers the ability of each spouse to earn and sustain themselves.
  3. Contributions to the Marriage: The role of each partner in managing the household, raising children, or contributing financially is assessed.
  4. Needs of the Wife and Children: If children are involved, their upbringing and future expenses are taken into account.
  5. Financial Liabilities of the Husband: The court examines any debts or obligations that may impact his ability to pay alimony.
  6. Lifestyle During Marriage: The standard of living maintained during the marriage is a key consideration.
  7. Career Sacrifices: If one spouse gave up career opportunities for the marriage, it influences the alimony amount.
  8. Independent Income Sources: If the wife has an independent source of income, it may reduce the alimony entitlement.

Can Men Claim Alimony?

Contrary to popular belief, alimony is not exclusive to women. Under Sections 24 and 25 of the Hindu Marriage Act, 1955, a husband can also seek alimony if he proves financial dependence on his wife. However, courts evaluate such claims strictly, requiring the husband to demonstrate that he is unable to earn due to valid reasons such as illness or disability.

Several celebrity divorces in India have involved significant alimony settlements:

  • Hrithik Roshan & Sussanne Khan: Reports suggest a demand of nearly ₹400 crore.
  • Saif Ali Khan & Amrita Singh: Saif had to pay a substantial amount in alimony.
  • Karan Mehra & Nisha Rawal: The court settled for an alimony of ₹1.5 crore.

How Is Alimony Decided in Other Countries?

Alimony laws vary across the world:

  • United States: Some states follow a fixed formula, while others allow judges to decide based on circumstances.
  • United Kingdom: The primary goal is to ensure that both partners can maintain a reasonable standard of living post-divorce.
  • Germany & France: Financial support is granted for a limited period.
  • China & Japan: Alimony is generally minimal and usually given as a one-time lump sum.
  • Middle East: Under Islamic law, alimony is usually restricted to the ‘Iddat’ period (waiting period after divorce).
