The Allahabad High Court granted bail to the rape accused. The student had alleged that a man met in the bar raped her in a state of intoxication. At the same time, the accused kept his side and said that the student was ready to go with her and had a relationship with consent. An FIR was lodged by the student under Section 64 of the Indian Justice Code in Gautam Buddha Nagar police station.

Justice Sanjay Kumar Singh gave this order. Nischal Chandak, who was accused in the case, was arrested on 11 December 2024. He was accused of raping a girl found at one time of Hauz Khas of Delhi. The court said that the girl herself had invited trouble and she is responsible for this alleged incident.

What did the student make allegations?

In her complaint, the student alleged that the accused Nischal Chandak was touching her in an objectionable manner. Instead of taking him to his house in Noida, he took him to his relative's flat in Gurgaon and carried out the incident. The girl lived in PG Hostel.

Let us know that in September 2024, a student studying in a big university in Noida went to Delhi with three friends. The student said that she got some acquaintance there, including the accused. The victim had told in the complaint to the Noida police that after drinking alcohol, she was in a state of intoxication and the accused was getting closer to her.

She was at the bar till three o'clock in the night and the accused was constantly asking her to take her with him. She told the police that due to repeated saying, she agreed to go with the accused to do 'rest'.

The accused said- relation was formed with consent

In the bail application, the accused told the court that the woman needed help and she herself agreed to go to the house with her. The accused has also denied the allegations that he took the woman to his relative's flat and raped twice. He claims that there was no rape, but a relationship with consent was formed.

What did the court say?

The court believes that even if the victim's allegations are accepted correct, then it can also be reached to the conclusion that she himself had invited trouble and she is also responsible for it. The medical examination found the hymen broken, but the doctor did not talk about sexual violence.
